Exclusive: Justice Department probing Chinese accounting (Reuters)

WASHINGTON (Reuters) ? The U.S. Justice Department is investigating accounting irregularities at Chinese companies listed on U.S. stock exchanges, said an official with the Securities and Exchange Commission, suggesting criminal charges may be brought in addition to civil proceedings.

"There are parts of the Justice Department that are actively engaged in this area," Robert Khuzami, director of enforcement at the SEC, said in an interview on Tuesday.

He told Reuters that a number of federal prosecutors around the United States were taking part in the investigation, but he declined to name them.

Involvement of U.S. attorneys general in various locations adds investigative firepower to the SEC and the Federal Bureau of Investigation, which are also probing the accounting methods of certain U.S.-listed Chinese companies.

"I think that you will see greater (Department of Justice) involvement as time goes on," Khuzami said when asked if criminal charges would be filed in the investigation.

A former federal prosecutor, he declined to elaborate on which Chinese companies or auditors were being scrutinized by the Justice Department.

An SEC review of accounting problems at foreign-based stock issuers sharpened its focus earlier this year when dozens of China-based companies began disclosing auditor resignations or book-keeping irregularities.

For example, Deloitte Touche Tohmatsu CPA Ltd in May resigned as auditor of Chinese software company Longtop Financial Technologies Ltd, saying it had found falsified financial records and bank balance confirmations.

Shares of some Chinese companies listed in the United States fell on Thursday after Khuzami's statements became public. Among them, Sohu.com Inc closed 4.7 percent lower at $50.62, Baidu Inc fell 9.2 percent to $110.29, China Sky One Medical Inc declined 3.8 percent to $2.29, and Sina Corp ended down 9.7 percent at $73.23.

The SEC has struggled to gain access to documents it needs in the investigation because strict Chinese laws have made auditors reluctant to turn them over.

The FBI has an embedded agent in an SEC working group on Chinese companies that enter the stock market through so-called reverse mergers with U.S. shell companies.

Officials from the SEC and the Public Company Accounting Oversight Board (PCAOB) are due to meet with their Chinese counterparts in Washington, D.C. in October for a second round of talks on joint inspections of auditing firms in China.

"Not having proper accounting and reliable audit review for publicly traded companies with operations in China is just not acceptable. We have to find a path to resolution of this issue," Khuzami said. "It is ... a big issue for us."

Earlier in September, the SEC sought a federal court order to force the Shanghai arm of Deloitte to turn over its work papers regarding Longtop Financial.

The results of the Deloitte subpoena enforcement action will be closely watched by other auditing companies, Khuzami said. The federal government is also pursuing other options to ensure better accounting practices at U.S.-listed companies based in China, he said.

"Obviously, the results here will inform the conduct of others that are similarly situated. In that sense, it's going to be instructive," Khuzami said. "At the same time, we're not a one-trick pony; There are other efforts to reach resolution of these issues. We continue to work closely with our regulatory counterparts in China and in other countries to find a path to resolution."

In a recent interview with Reuters, Assistant Attorney General Lanny Breuer, head of the Justice Department's criminal division, underscored the government's commitment to fighting accounting fraud of any kind. He declined, however, to comment on specific cases that could be brought against Chinese firms listed in the United States.

The Justice Department declined comment for this story, saying it does not confirm or deny investigations.

In any criminal case, the question would be whether the company lied to the auditor, or whether the auditor acted recklessly or knowingly in not detecting the alleged fraud.

Merely not providing records under these circumstances -- as in the Deloitte case -- would not likely rise to the level of criminal violation, Khuzami said.

The PCAOB, the agency that oversees auditors of public companies, has inspection authority over auditing firms, while the SEC has enforcement authority over those companies.

Together, the two agencies have greater leverage over auditing firms than do criminal authorities, Khuzami said.

Stevens appointed new Schalke coach

BERLIN (AP) -Huub Stevens has been appointed as coach of German club Schalke to replace Ralf Rangnick, who stepped down last week.

"I'm happy to be back," Stevens said at a news conference Tuesday after signing a contract through 2013. "The club is in my heart."

The 57-year-old Dutchman previously coached Schalke from 1996-2002, becoming the club's longest-serving coach. He led the club to the UEFA Cup title in 1997, the German Cup in 2001 and 2002, and came agonizingly close to winning the league in 2001 when Bayern Munich snatched the title.

"It's not for nothing people say: 'Once a Schalker, always a Schalker,"' Stevens said after about 1,000 fans showed up for his first training session in charge.

"There were harmonious talks with the club," Stevens said. "The past few days were hectic. It's not important what happened in the past, but what happens today and tomorrow. I look forward to the challenge."

Schalke general manager Horst Heldt said the club "didn't want to experiment."

"Huub's coming home, and his fire is burning. We've seen that other clubs have success with experienced coaches who still have fire burning inside," Heldt said.

Rangnick surprised Schalke by leaving Thursday after just six months in charge, citing burnout. Schalke team doctor Thorsten Rarreck said the 53-year-old had no choice but to quit immediately "before he imploded."

Rangnick had taken over from Felix Magath at the end of March.

"It's important that Ralf Rangnick returns," Stevens said. "I sent him a text message ... I think he showed great courage in making this decision."

Stevens was the favorite to take over at Hamburger SV, another former club, following the sacking of Michael Oenning but talks broke down on Sunday evening.

"I didn't say 'No' to Hamburg," Stevens said. "Hamburg said to me that they were speaking with several candidates. So I also find I have the right, as a coach, to speak with other clubs."

Stevens will face Hamburg in the Bundesliga on Sunday, after Thursday's Europa League match against Maccabi Haifa.

Schalke is fifth after seven league games, six points behind Munich.

"There's a lot of potential in the team. But the right balance still has to be found. I want football that the fans can appreciate," Stevens said.

Stevens also coached German sides Hertha Berlin and Cologne, as well as Dutch clubs Roda JC and PSV Eindhoven. His most recent job was with RB Salzburg, which he led to the Austrian title in 2010.

White Sox agree to let Guillen out of contract (AP)

CHICAGO ? Unable to get a contract extension, Ozzie Guillen walked away from the Chicago White Sox.

Guillen's quest for a new deal was denied, so the talkative, sometimes outrageous and always colorful manager asked to be released from his current contract Monday.

That request was granted.

After Guillen met with owner Jerry Reinsdorf, the team agreed to release him from his current deal and his eight-year managerial run that included a World Series title in 2005 was over. He managed his final game Monday night as the White Sox beat the Blue Jays 4-3.

"It was a great talk, very nice," Guillen said. "Jerry knows it was a decision I had to make. He respects my decision.

"It was my call and I appreciated the White Sox organization letting me do what I like to do and what is best. ... Maybe not the best, maybe it's the worst. You don't know what is out there. Maybe I'm dreaming. I might not appreciate what I got here. You don't know. You have to close the page and move on. That's life. Hopefully the next book treats me the way this book treated me."

Guillen, whose contract option for 2012 was picked up at the team's winter convention in January, began talking late last month about an extension, even with the team going through a disappointing season.

"We certainly cannot thank Ozzie enough for all he has done during his eight seasons as manager of the Chicago White Sox, highlighted by an unforgettable 2005 World Series championship," Reinsdorf said in a release issued by the team.

"I personally appreciate everything he has done for this organization, our fans and the city of Chicago. We shared the greatest moments together and wish him nothing but future success in baseball and in life."

The White Sox said in the release they retain the right to compensation should Guillen accept a managerial position with another major league team for the 2012 season. Guillen, who had a 678-617 record with the White Sox, will not be in uniform for the remaining two games this year.

The Florida Marlins talked to Chicago last year about acquiring Guillen, but the deal never materialized. They could bring him in now to lead the club into a new ballpark next season.

"It could be anybody. They sound like they are interested," Guillen said.

Guillen is the only manager in franchise history to lead the White Sox to more than one division or league title. Chicago also made the playoffs under Guillen in 2008. But they floundered this season.

"No regrets, no regrets," Guillen said. "Very disappointed in this year, yes."

In the 2005 championship year, the White Sox nearly let a 15-game lead evaporate before rebounding in the final week of the regular season. Then they went 11-1 in the postseason, clinching all three of their series against the Red Sox, the Angels and the Astros on the road. It was their first title since 1917.

But after teaming with general manager Ken Williams to end the 88-tear drought, their relationship has become strained over the last two years.

The White Sox (78-82) were built to win this year but middle-of-the-order players like Adam Dunn and Alex Rios slumped all season and bogged down the offense.

Chicago had early losing streaks of seven and five games and by May 1, Guillen's club was 10 games out of first. It pulled within 3 1/2 games of the lead on Aug. 17 but that was as close as it would get the rest of the way.

Guillen was a managerial trend setter with a Twitter account and a website. And social media, like his opinions expressed in other forums, got him in trouble at times.

After he was ejected this season at Yankee Stadium by umpire Todd Tichenoran, the manager went on Twitter and called his ejection pathetic. That got him a two-game suspension and fine, and it was the first time baseball has penalized a player, coach or manager for using the social networking site during a game.

Social media played a role in the creating tension between Williams and Guillen in 2010. Guillen's son, Oney, left the team's scouting department after posting some comments on Twitter that were critical of the team's front office.

Guillen said he spoke Monday with Reinsdorf to get an idea about his future. He leaves on a vacation in Spain later this week.

He and Reinsdorf have been close since Guillen's playing days as a slick-fielding shortstop when he was the 1985 AL Rookie of the Year with the White Sox. He played 13 of his 16 big league seasons with the White Sox.

"Was it time for a change? I don't think so," Williams said. "I guess things were accelerated. We had no intention of firing him. This was kind of acquiescing to some of his desires more than anything. It is what it is. I don't wish to expound on any of the peripherals to the degree that they become more of a story than they really are.

"This is a case of a man making a business decision for himself and his family. And we respected it, we respected it enough to allow this to happen. Obviously we didn't agree to the request for an extension."

Since he took over in 2004, there has been a long list of Ozzie blowups and tirades and opinionated rants.

In 2006, Guillen was fined and ordered by Commissioner Bud Selig to undergo sensitivity training after he described then Chicago Sun-Times columnist Jay Mariotti with a derogatory term.

In 2008 he went on a rant, saying Williams needed to make some changes. His comments also miffed batting coach Greg Walker before everything was patched up. He once lambasted former White Sox star and countryman Magglio Ordonez with a four-letter verbal surge after Ordonez joined the Tigers and said Guillen was now the enemy.

As he was riding to Wrigley Field for a game against the Cubs, Guillen called into a radio station and went on another profanity-filled tirade after a host questioned why he wasn't starting A.J. Pierzynski that day.

There were many more incidents, some of them raising eyebrows. Guillen once told reporters that "no comment" was not part of his vocabulary.

Family: Missing cyclist may have brain cancer (AP)

PORTLAND, Ore ? Nearly two weeks after Mark Bosworth vanished during a seven-day bicycle tour along scenic roads in Oregon, police still have no idea where the 54-year-old cancer survivor went. He left everything behind: clothing, his wallet and credit cards, and his bike.

Relatives are convinced Bosworth is alive, maybe so confused that he has forgotten that his home is in Portland. They suspect a recurrence of lymphoma that may have spread to his brain and caused symptoms of dementia.

In the early morning hours of Sept. 17, the day after Bosworth disappeared, a man wearing similar clothes was seen hitchhiking on a road outside the town of Riddle, where cyclists camped. His wife, Julie, wonders whether he's is trying to get to New York City, where the couple lived for 10 years.

"I can imagine Mark being on I-90, getting by with 40 bucks in his pocket and a stranger's kindness, being confused but strong enough to be on the road," she told The Associated Press.

She hopes that her husband is still alive, maybe catching a ride with someone, maybe walking down some city street, that someone will recognize him, tell him people are looking for him, and that he needs to go home.

As he has in years past, Bosworth this year signed up as a volunteer for Cycle Oregon, an annual bike tour that drew 2,400 riders from around the region and took them on some of the most scenic routes in the state. Although Bosworth was part of the tour's support team, he brought his bike in case he had time to ride.

But days before the start, Bosworth was complaining of headaches.

He brushed them off, saying they were probably caused by muscles he had pulled while working on his bike. His wife wasn't so sure and told him so. He made appointments to see his internist and oncologist, but set them up for after the race.

During the trip, some had noticed uncharacteristic behavior from Bosworth. He failed to show up for some volunteer shifts, would stare into the distance while standing by himself and had difficulty following signs. When asked if he needed help, he said he was fine.

In a morning telephone conversation with his wife two days before he vanished, Bosworth said Cycle Oregon had surprised everyone by flying cyclists to Ontario, Canada. In a phone call with his wife later that day he acknowledged it was a strange thing to say and tried to explain it away by saying he must have been having a vivid dream just before they talked earlier in the day.

Julie Bosworth thinks her husband was trying not to deal with the possibility he might be having a cancer relapse until he got back.

Police say it does not appear that Bosworth was a victim of foul play. After talking with Bosworth's doctors and relatives, investigators believe some medical episode is behind Bosworth's disappearance, said Lt. Chris Merrifield, of the Douglas County Sheriff's Office.

The search continues. Friends, relatives and others have distributed posters from the Canadian border into California and set up a blog, as well as Facebook and Twitter accounts dedicated to getting Bosworth's photo out there and getting him home.

Bosworth is a map expert with Metro, a regional government entity for the greater Portland metropolitan area, as well as an avid cyclist, musician and cook.

Cyclist Greg Bolen spent time with Bosworth several hours before he disappeared.

At a beer garden set up by Cycle Oregon, Bosworth told Bolen he was going to the bathroom while they waited for pizzas, but he didn't return to the table. When Bolen saw him later that day Bosworth said he ran into someone, got to talking and lost track of time.

Bolen last saw Bosworth at about 9:30 on the night of Sept. 16, as they were walking back to the campsite.

Mark and Julie Bosworth were planning to fly to London this weekend to celebrate their 25th wedding anniversary. Instead, she will be continuing to help in the search for her husband.
