Second Mile's insurance company asks to pay no claims for Jerry ...

An insurance company for a charity founded by Jerry Sandusky argued in a federal complaint Friday that it should not have to pay legal expenses or claims for the former Penn State assistant football coach accused of molesting children.

Federal Insurance Co. said it would be wrong for the company to have to cover Sandusky because he is accused of conduct that did not involve his position as an executive or employee of The Second Mile, a charity for at-risk youth he founded in 1977.

In addition, "Pennsylvania courts have found that a person who sexually abuses a minor should not expect his insurer to cover his misconduct, particularly where the average insured purchasing insurance would cringe at the very suggestion that he was paying for coverage arising out of sexual abuse of a child," lawyers for the New Jersey-based company wrote.

Sandusky is charged with sexually abusing 10 boys over more than a decade. He has denied the allegations and is awaiting trial in Centre County after waiving a preliminary hearing earlier this month.

His criminal defense lawyer, Joe Amendola, said Friday he had not seen the complaint, filed in federal court in Williamsport. Amendola said Sandusky was served Wednesday with a lawsuit filed in Philadelphia by one alleged victim and was getting a different lawyer to represent him in civil cases.

"I can say it's not unexpected that the insurance carrier would attempt to get out from under representing Jerry," Amendola said.

Dennis Mulvihill, a lawyer for Federal Insurance, referred questions to Mark Greenberg, the company's chief information officer. Greenberg did not immediately return a message left at his office after hours Friday.

A spokesman for The Second Mile said the matter was between Federal and Sandusky, and declined further comment.

The complaint asks the court to rule that Federal has no obligation to pay Sandusky's criminal defense costs or to indemnify him for civil or criminal claims related to alleged sexual abuse of children.

"Extending insurance coverage to Sandusky is unlawful because providing insurance coverage for claims arising from sexual assault, molestation, and/or abuse of minors is repugnant to Pennsylvania public policy," according to the complaint.

Amendola said Sandusky has not sought coverage regarding the criminal case.

More Schooling Might Raise IQ (HealthDay)

MONDAY, Dec. 26 (HealthDay News) -- Children who have more schooling may see their IQ improve, Norwegian researchers have found.

Although time spent in school has been linked with IQ, earlier studies did not rule out the possibility that people with higher IQs might simply be likelier to get more education than others, the researchers noted.

Now, however, "there is good evidence to support the notion that schooling does make you 'smarter' in some general relevant way as measured by IQ tests," said study author Taryn Galloway, a researcher at Statistics Norway in Oslo.

Findings from the large-scale study appear in this week's online edition of the Proceedings of the National Academy of Sciences.

IQ, or intelligence quotient, is a widely accepted measure of intelligence. The IQ score comes from several combined, standardized tests.

In 1955, Norway began extending compulsory middle school education by two years. Galloway and her colleague Christian Brinch, from the department of economics at the University of Oslo, analyzed how this additional schooling might affect IQ.

Using data on men born between 1950 and 1958, the researchers looked at the level of schooling by age 30. They also looked at IQ scores of the men when they were 19.

"The size of the effect was quite large," she said. Comparing IQ scores before and after the education reform, the average increased by 0.6 points, which correlated with an increase in IQ of 3.7 points for an addition year of schooling, Galloway said.

"We are only able to study men, because we use data on IQ from the Norwegian military's draft assessment, which basically all men undergo around the age of 19. Women are not included in the draft," she explained.

Education has lasting effects on cognitive skills, such as those broadly measured by IQ tests, Galloway said.

"Cognitive skills are, in turn, related to a large range of social and economic outcomes. A large part of the relevance of the study derives from the fact that there has been some controversy related to the question of whether education has an independent effect on IQ or whether people with higher IQs simply choose, or are better able, to attain higher levels of education," Galloway said.

By looking at a reform which increased mandatory schooling and prevented people from dropping out of school after the 7th grade, it is fairly certain that the effects seen are an effect of schooling on IQ, not vice versa, she explained.

"One subtle point of our findings is that we use IQ measures at roughly age 19, which is three to four years after the additional education generally was received. Thus, we are not simply picking up a short-lived effect that peters out shortly after people leave school," Galloway said.

The findings suggest that education as late as the middle teenage years may have a sizeable effect on IQ, but do not challenge the well-documented importance of early childhood experiences on cognitive development, according to the authors.

Robert Sternberg, a professor of psychology and provost at Oklahoma State University in Stillwater, said that "these results -- that schooling has a substantial effect on IQ -- replicate those of other, perhaps not quite as well-controlled, studies."

"I am aware of no serious studies that show the opposite result," he added.

He said the results are also consistent with the huge literature on the so-called Flynn effect showing that IQs are modifiable across as well as within generations and have been rising since the beginning of the 20th century.

"The results of this study are problematical for the chorus of psychologists and educators still locked in century-old thinking that IQ is genetic, stable and non-modifiable," Sternberg said. "As, for these individuals, the belief in the stability of IQ is more a matter of religious faith than of scientific inference, I doubt they will be persuaded."

Back in campaign mode, presidential hopefuls focus (AP)

DES MOINES, Iowa ? Republicans in search of their party's presidential nomination are returning to campaign mode after a brief Christmas respite, with Rick Santorum planning a hunting trip with conservatives in Iowa and Mitt Romney phoning supporters.

With just a week until Iowa holds its leadoff caucuses and many still undecided, the final push ahead of the Jan. 3 contests was heading into a critical time. Campaigns planned new television ads and phone calls to persuade holdout caucusgoers still weighing their options.

Romney, who kept this state at arm's length for most of the year, seemed to increase his efforts in Iowa as polls found him in a stronger position. He planned to talk with supporters in a series of telephone calls here and to New Hampshire and Florida on Monday between working on a speech that aides described as his final pitch to Iowans. Romney planned to deliver that speech Tuesday evening and then set out on a bus tour of Iowa.

However, he was to share the highways with Rep. Michele Bachmann, Texas Gov. Rick Perry and former House Speaker Newt Gingrich. All scheduled bus tours to start then, too.

Each is running out of time and looking to derail Rep. Ron Paul, the Texas congressman who seems to have the most sophisticated network of volunteers ready to organize ahead of the caucuses. Paul was to return to Iowa this week to meet with supporters he has kept in touch with since his unsuccessful run in 2008.

Others, too, were ready to turn on their own political machines and had fresh ads ready to air.

Gingrich, who last week criticized the negative tone of the campaign, was ready to directly challenge Romney on the economy, an issue Romney has made central to his campaign. Gingrich's standing in public and private polls has slipped as he faced unrelenting criticism from the candidates and their allies.

Gingrich was expected to use clips from Romney's previous campaigns distancing himself from President Ronald Reagan and pitch Gingrich's economic plan as "Reaganomics 2.0." Gingrich also was expected to compare Romney's tax plan with his own.

Santorum, meanwhile, planned to announce support from another wave of Iowa conservatives. He scheduled a pheasant hunting trip in Adel for Monday afternoon. While he trails in polls and has not spent significant money on ads, Santorum is hoping his nonstop courtship of Iowans yields a late surge. He visited all 99 of Iowa's counties during the summer ? an accomplishment Bachmann has feverishly tried to replicate.

Bachmann, a congresswoman from Minnesota, last week darted through small towns, reminding voters that Santorum lost his 2006 re-election bid in a blowout and that Paul's foreign policy views were outside the party's orthodoxy. Looking to recapture voters' interest, her plan was to return to hand-to-hand campaigning on Tuesday.

Perry, too, was looking to keep up his message: his rivals are insiders unable to change Washington. He planned to return to his tour bus on Tuesday.

Meanwhile, former Utah Gov. Jon Huntsman kept his focus on New Hampshire. Early in the campaign, he said he would not compete in Iowa and instead make his start in New Hampshire, which comes second on the nominating calendar.
